Copyright and Content Notice

Notice-and-takedown procedure for right holders and anyone who believes their rights have been infringed.

Translation notice: This is an English translation provided for convenience. The Turkish version (Telif ve İçerik Bildirimi) is the legally binding text; if the two versions differ, the Turkish version prevails. Notices may be sent in English or Turkish.

1. Our principle

SameScene respects intellectual property rights. Under the Terms of Use, users may only share content they have the right to watch; pirated content and unauthorised streaming are prohibited.

2. What we can and cannot do

For your notice to be effective quickly, it helps to know how the Service works. SameScene does not host, store or transmit any video file through its server.

YouTube videos

The video is played directly from YouTube through YouTube’s official embedded player. Only YouTube can remove the video itself. We recommend also using YouTube’s copyright notification process to have the content removed at its source. We can remove the video from the room and block that video from being opened on the Service again.

Direct video links

The file is hosted on the third-party site the link points to and is loaded from there by the viewers’ browsers. To have the file removed, you also need to contact that site’s hosting provider. We can remove the link from the room, close the room and block the link from being opened on the Service again.

Streaming from a computer

The video travels live from the streaming person’s device to the viewers over a peer-to-peer (WebRTC) connection; the file never reaches our server and we have no copy of it. We can close the room where the stream is taking place and so end that stream.

In short, our technical means are limited to: removing the video/link from the room, clearing the chat, closing the room, temporarily or permanently blocking the room code, and blocking the reported video link or YouTube video from being opened on the Service again. We have no way of blocking individual people (e.g. by IP address). Because there is no account system and data is not stored permanently, we generally hold no information about users’ identity; any such information is shared only upon a lawful request by the competent authorities and to the extent it exists.

Rooms are usually short-lived: 10 minutes after the last person leaves, the room and everything in it is deleted automatically.

3. How to send a notice

Send your notice to info@samescene.com with “Copyright Notice” (or “Telif Bildirimi”) in the subject line. So that we can assess it, your notice must include:

Identity and contact details: the right holder’s name and surname or business name, e-mail address, telephone number and address.
Authority: if you are acting on behalf of the right holder, a document showing your authority to represent them (power of attorney, letter of authorisation, collecting-society membership, etc.).
The work: the title and description of the work allegedly infringed; information or documents showing your ownership of the rights.
Where the infringement is: the room link or room code (e.g. samescene.com/r/abc12345), the video link opened in the room or a description of the stream, and the date and time you saw the infringement.
Statement: a statement that you believe in good faith that the use is not authorised by the right holder, their representative or the law, and that the information in the notice is accurate.
Signature: a handwritten signature (scanned) or a secure electronic signature.

We may ask you for more information if a notice is incomplete. False or bad-faith notices may give rise to legal liability for the person sending them.

4. After a notice

We review properly submitted notices as a priority and, if the infringement is evident, apply the measures listed above within 3 days at the latest of receiving the notice.
If the room no longer exists at that time (e.g. it was deleted automatically), we may block the reported room code and link from future use.
We will inform you of the outcome by e-mail.

5. Counter-notice

If you believe your content or room was removed because of a mistaken notice, you can send your reasons and any information showing your right to use the content to info@samescene.com. We will assess your counter-notice and, if necessary, share it with the party who sent the notice. The final resolution of the dispute rests with the competent courts.

6. Repeat infringements

We apply graduated and proportionate measures against repeated infringements: on the first infringement, removal of the content and closure of the room; on repetition, permanent blocking of the room codes and video links/YouTube videos concerned. In clear and serious cases (e.g. systematic piracy) we may apply these blocks on the first occasion. Because there are no accounts, we do not block individual people (e.g. by IP address).

7. Personality rights and other unlawful content

If you believe that a video, stream or message in a room infringes your personality rights or the privacy of your private life, you can write to the same address with the subject “Content Notice” (or “İçerik Bildirimi”). We assess such notices within the time limits set by Law No. 5651. Under that law you can also apply directly to a criminal judgeship of peace.

Child abuse content

If you see content constituting child sexual abuse, please report it to us and also directly to the competent authorities (e.g. the İhbar Web hotline of Türkiye’s Information and Communication Technologies Authority, or the police). Do not save such content on your device or share it with others.

8. Applicable legislation

This procedure is applied in accordance with Turkish law, in particular:

Law No. 5846 on Intellectual and Artistic Works — the rights of authors and holders of related rights; the procedure for removing content in case of infringements on the internet (in particular Additional Article 4).
Law No. 5651 on the Regulation of Publications on the Internet and Combating Crimes Committed by Means of Such Publications — the obligations of content and hosting providers; removal of unlawful content once notified; remedies for infringements of personality rights.
