Terms of Use

1. Parties and acceptance

These Terms of Use govern the relationship between Yasin Mert, an individual who operates the SameScene service (the “Service”) available at samescene.com in a personal capacity (“we”, “us”), and the person using the Service (“you”). By using the Service you confirm that you have read and accept these terms. If you do not accept them, please do not use the Service.

How your personal data is processed is explained in the Privacy Notice (KVKK Information Notice).

2. What the service is

The Service is a free tool that requires no account and lets you create a “room”, watch the same video in sync with the people you share the room link with, chat, and send emoji reactions. A video can be opened in three ways:

• YouTube link — the video is played directly from YouTube through YouTube’s official embedded player;
• direct video link — each viewer’s own browser loads the video from the third-party server the link points to;
• streaming from your computer — the file is not uploaded to any server; the browser of the person who picked the file streams the video to the viewers over a peer-to-peer (WebRTC) connection.

The Service does not host, store, copy or transmit any video through its server. The server only temporarily holds and relays the room state (which video is open, the playback position), display names and chat messages.

3. Minimum age

You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the permission and under the supervision of your parent or guardian. Parents and guardians are responsible for how their children use the Service.

4. Content: who is responsible for what?

The videos opened in a room, the links shared, the files streamed and the messages written are chosen and shared by users; we do not choose, pre-screen or approve them. You are responsible for everything you share. In particular:

• You must hold the rights or permissions needed to watch the video you open or stream with the people in the room, or that use must be permitted by law. Videos you filmed yourself (e.g. family and wedding videos) usually meet this condition; still, respect the rights of other people who appear in the video.
• You must not record and stream content from a streaming platform (e.g. paid series/film services) in a way that platform does not allow.
• YouTube videos are subject to the YouTube Terms of Service.

5. Prohibited uses

You may not use the Service for the following purposes or in the following ways:

• sharing or streaming content protected by copyright or other intellectual property rights without the right holder’s permission; linking to pirated content, illegal streams or unauthorised copy sites;
• sharing any unlawful content or facilitating any unlawful activity;
• any content constituting child sexual abuse; content that sexualises or harms minors (we report such content to the competent authorities);
• sharing obscene/sexual content without the consent of the people concerned, or spreading private images of people;
• harassing, threatening or demeaning others; posting hate speech or content inciting violence;
• sharing other people’s personal data or information about their private life without permission; impersonating another person or organisation;
• sharing spam, unsolicited advertising, scams, or malware/phishing links;
• attempting to disrupt the security or operation of the Service: overloading the server, opening rooms in bulk with automated tools, trying to bypass security measures, or trying to guess room codes to enter other people’s rooms without permission;
• using IP addresses learned during a WebRTC connection to track, harass or attack others.

6. Rooms and privacy

Rooms are not password-protected: anyone who has the room link or code can join the room and see the names of the people in it and the recent chat messages. Share the link only with the people you want to watch with. When streaming from a computer, participants’ IP addresses may be visible to each other; see the warning on the Privacy page for details.

7. Dealing with misuse

If we notice, or are notified of, a use that breaches these terms or the law, we may — within our technical means, in proportion to the seriousness of the case, and without prior notice:

• remove the video from the room or clear the chat,
• close the room and temporarily or permanently block its room code,
• block certain video links or YouTube videos from being opened on the Service,
• cooperate with the competent authorities where required by law.

As there are no accounts, we do not block individual people (e.g. by IP address); our measures apply to rooms, room codes and video links.

8. Provision of the service

The Service is free and provided “as is” and “as available”. We run the Service as an individual with limited resources. We therefore cannot guarantee that the Service will be uninterrupted or error-free, or that it will work on every device, browser and network; nor that every video can be played or that synchronisation will always be perfect. The server may be restarted for maintenance, updates or technical reasons; in that case open rooms and chat history are deleted. We may change the Service’s features, suspend the Service temporarily, or discontinue it entirely after announcing this on the home page a reasonable time in advance.

9. Limits of liability

To the extent permitted by law:

• We are not responsible for the videos, links, streams and messages shared by users, or for the content and services of YouTube and other third-party sites. When we are notified of unlawful content, we act as described on the Copyright and Content Notice page.
• Given that the Service is free, we cannot be held liable for indirect losses (e.g. loss of profit) arising from interruptions of the Service or from some videos not playing.

Nothing in this section limits our liability for damage caused by our intent or gross negligence, or for harm to life and physical integrity, and nothing in it removes your rights under mandatory law, in particular Turkish Law No. 6502 on Consumer Protection.

You are responsible, under the general provisions of law, for damage suffered by third parties as a result of your use in breach of these terms.

10. Intellectual property

The rights in the SameScene name, logo, interface design and software belong to us or are licensed to us. You are granted a limited, non-exclusive and non-transferable permission to use the Service personally in accordance with these terms. We do not claim any rights over the content users share.

11. Third-party services

The Service works together with third-party services such as the YouTube embedded player, third-party video links shared by users, and Google’s public STUN server for WebRTC connections. These services are subject to their own terms and privacy policies; we cannot guarantee their availability.

12. Changes to these terms

We may update these terms as the Service or the law changes. The current text is published on this page and the “Last updated” date is changed. We announce significant changes on the home page for a reasonable time before they take effect. Changes do not apply retroactively; continuing to use the Service after they take effect means you accept the new terms. If you do not accept the new terms, you can stop using the Service; since there is no account or fee, this costs you nothing.

13. Governing law and disputes

These terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of the Republic of Türkiye have jurisdiction over disputes. If you act as a consumer, your right to apply to the consumer arbitration committees and consumer courts at your place of residence or where the transaction took place, within the monetary limits set by law, is reserved. If you live outside Türkiye, your rights under the mandatory consumer-protection rules of your country of residence are not affected by this choice.

If any provision of these terms is found invalid, this does not affect the validity of the other provisions.
